MOTOR VEHICLE REPAIR COMPLAINT REPORT I. OBJECTIVE OF COMPLAINT This formal complaint is filed with the FDACS Division of Consumer Services to request an immediate regulatory inspection and consumer arbitration regarding predatory diagnostic fee-churning, warranty non-compliance, and deceptive service safety omissions by Fields BMW ([XXX] and [XXX] branches). Despite exhaustive photographic evidence of mechanical failure documented by an independent, ASE-certified specialist, Respondent dealerships have actively refused to inspect structural items covered under a 24-month manufacturer parts warranty. Instead, they have extorted predatory diagnostic deductibles, charged for unnecessary ancillary services, and left a severe drivability safety hazard unaddressed. II. CHRONOLOGICAL LOG OF IRREGULARITIES & REPAIR NEGLECT Mid-2025 | Initial Safety Incident & Repairs ([XXX]): The vehicle exhibited dangerous stalling and severe hesitation under acceleration. At red lights on semi-highways and during slow right turns, depressing the gas pedal resulted in a complete failure to launch, creating an immediate risk of rear-end collisions. Capital BMW ([XXX]) diagnosed shattered engine mounts and torn front control arms. Triton Extended Warranty authorized and paid to replace these structural components under a 24-month manufacturer parts warranty ecosystem. XXX–XXX | Recurrence of Severe Symptoms & Independent Verification: After relocating back to the [XXX] area, the severe hesitation, drivetrain jerking, failure to accelerate after a stop, and a prominent knocking noise in the front right well returned. The vehicle was taken to Precision Sport Industries (PSI) in [XXX]. PSI technicians performed a full teardown inspection and captured undeniable photographic proof that the engine mounts and control arms installed by the [XXX] dealer had prematurely torn, failed, and displaced. PSI contacted Triton Warranty, who directed that the ca INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)
While driving on the interstate, the drivetrain malfunction warning appeared causing the car to become "limp." This limp mode caused a sudden inability to accelerate in a lane requiring mobility to avoid collision with merging right lane traffic. If this car had not already been in the far right lane, it would have potentially cause a serious hazard in a high traffic area. Prior to this drivetrain warning, the vehicle had been serviced at BMW twice in the past 6 months. December of 2024 the battery was replaced. All 4 run flat tires were purchased new in April. By the end of April this drivetrain malfunction occurred requiring a tow back to BMW. Initially they diagnosed the battery as bad, though I informed them that shouldn't be happening since the battery was purchased just a few months prior. After more testing, I was informed that the battery is fine but the throttle body is draining it. This is a part that should last throughout the life of the engine. I asked if there was any way this could have been diagnosed during previous service, as this is a serious failure and had I not told them I already bought a new battery I would have had another incorrect diagnosis and further engine damage.

NHTSA received a petition on or about July 18, 2022, requesting that Federal Motor Vehicle Safety Standard (FMVSS) 141 be applied to all electric and hybrid vehicles operating in the United States. The petition can be reviewed at NHTSA.gov under ODI Number 11486072. FMVSS 141 establishes performance requirements for pedestrian alert sounds for motor vehicles. The standard applies to hybrid and electric vehicles that have a gross vehicle weight rating of 4,536 KG or less or are defined as low-speed vehicles. The standard became fully applicable to all such vehicles manufactured on or after March 1, 2021.On January 27, 2023, NHTSA opened Defect Petition (DP) 22-005 to evaluate the subject matter described in the petition. On June 24, 2023 and as supplemented on June 25, 2023, the petitioner notified NHTSA he was withdrawing his petition. The petitioner indicated that, based on his review of data, there is no justification for asserting potential benefits that could be derived from actions sought by my petition. Based on the petitioner's withdrawal, DP22-005 is closed. Closure of this DP does not represent a determination by NHTSA regarding the subject matter of the petition.
