As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 111, "Rear Visibility."

Tesla released an over-the-air (OTA) software update, free of charge. Tesla will also identify any vehicles that experienced a circuit board failure, or stress that may lead to a circuit board failure, and replace the affected computers, free of charge. I am reporting a potentially serious rear suspension safety defect involving a 2024 Tesla Model Y manufactured in January 2024. On August 22, 2026, during tire service, technicians demonstrated excessive movement of the right-rear wheel while applying torque. I observed the entire wheel visibly shifting relative to the wheel opening and recorded the movement on video. I postponed a prepaid wheel alignment and scheduled a Tesla inspection. Tesla subsequently confirmed excessive play in the right-rear upper ball joint and replaced it. During this repair, Tesla discovered that the retaining nut was missing from the right-rear upper fore-link-to-subframe connection and that the corresponding subframe mounting hole was elongated. A missing suspension retaining nut and elongated mounting hole could compromise the structural integrity of the rear suspension, potentially causing instability or suspension separation while driving. The vehicle sustained a rear-end collision on May 29, 2026, but remained drivable without observable suspension symptoms immediately afterward. The cause of the subsequently discovered damage remains undetermined. Tesla denied coverage for the subframe. Tesla’s service documentation shows that the rear upper fore-link tightening specification increased from 76 Nm to 84 Nm on October 25, 2023, before this vehicle was manufactured. I request investigation into whether inadequate fastener retention, loss of clamping force, or an assembly or design defect could contribute to this failure. The vehicle remains unrepaired at a Tesla-certified collision facility in Massachusetts, with the damaged subframe available for inspection. I request that NHTSA investigate this potential safety defect, examine similar complaints, and consider inspecting the vehicle before the damaged components are removed or discarded. Photographs, video, technician findings, and repair estimates are available upon request.

I have been rear-ended three times within the past 9 months while using FSD on my 2024 Tesla Model Y. First while obeying a yield sign, second, stopping abruptly for a vehicle making a right turn on red, and yesterday hit by another vehicle backing out of a parking lot space. No personal injuries were involved in any of these situations. My out of pocket costs for the first 2 incidents has totalled about $3,500. I dont yet have the estimate for the latest incident or the likelihood and extent of insurance coverage. Up until using FSD, I had not been involved in any collision for at least 25 years.

Safety Critical Bug: While driving on surface streets, FSD indicated (via initiating a right turn signal) it was going to make a right turn into a parking lot that was not specified on its current navigation path. I disengaged FSD. After disengaging FSD, the turn signal software remained in an active right-turn state. Physical turn signal stalk inputs (both light taps and full pushes in either direction) failed to override or cancel the signal. Vehicle continued signaling a right turn, and the signal could not be manually cancelled. Only after about a minute of driving straight, did the signal self-cancel.

The rear camber adjustment continues to move out of spec on my 2024 Tesla Model Y which causes excessive wear on the inside of the rear tires. My last alignment was completed on June 23 , 2026 with new tires by Tesla and the tires have already started showing severe wear on the inside of the rear tires. When this first happened in July 2025, the tires wore on the inside so much that my tire went flat while I was over 130 miles away from home at [XXX] in the morning on [XXX], the conditions were very unsafe. This problem has been re-produced several times and has cost me over 3500 dollars in tires and fees. There were no symptoms prior to the incidents because the tires looked great from the outside. While my Tesla was backing out of my driveway under Full Self-Driving, I saw people approaching and took over manual control. Immediately after I disengaged FSD, a touchscreen survey asking “Why did you intervene?” appeared and covered their representation in the high-fidelity proximity visualization. At the moment I took control because people were approaching, the survey obscured information about those people that I needed to monitor while maneuvering. My primary complaint is that a feedback request blocks safety-relevant proximity information immediately after the driver takes over, including while the vehicle is still moving. The survey also blocks media controls and other content on the left side of the screen. Regaining access requires dealing with the survey, creating an additional reason to look away from the road during the transition to manual driving. I am asking NHTSA to investigate this interface design. Tesla should keep the proximity visualization and controls unobstructed and defer the feedback survey until the vehicle is parked.

FSD apparently failed to detect it in time; the car hesitated and paused directly in the path of the oncoming vehicle. I had to press the accelerator to avoid a serious collision. FSD's judgment at complex intersections with fast oncoming traffic appears inadequate. Street name unknown.

I was slowing for a red light - I was nearly stopped a safe distance behind the car in front of me, then my Tesla applied automatic emergency braking. There was absolutely no danger or imminent accident. I was not injured, but my dog was thrown forward and hit the dashboard. This happened again when I went to accelerate as the light turned green - I got up to about 5 mph and automatic emergency braking was applied again, this time nearly causing the car behind me to rear-end me (and it generated a few honks as the Tesla wouldn't let me drive through the green light). This is the latest incident - AEB has been triggered two other times in the past year, both times worse than this, but I didn't have video and didn't know where to report it. This has been reported to Tesla, no response (yet). The vehicle/component has not be inpsected by anyone. No warning lamps were on prior to the failure. (note - i do have video of the incident, but i doesn't let me upload mp4)

On XXX, my wife activated FSD while our Tesla Model Y was parked in a parking lot. The vehicle began reversing and collided with another stationary vehicle behind it. Although the other vehicle showed no visible damage, our Tesla suffered significant deformation to its trunk and rear body panels, with estimated repairs of $5,000–$15,000. My primary concern is that FSD apparently failed to detect or respond appropriately to a stationary vehicle directly behind it. Such a failure could have caused serious injuries if a pedestrian or child had been present. Additionally, I requested my vehicle data from Tesla, but the "Video Recording" section was empty. I am concerned about the missing footage and the availability of critical evidence needed to determine what happened. I respectfully request NHTSA to: Investigate the suspected FSD object-detection and reversing safety failure. Request preservation and review of relevant Tesla camera recordings, FSD logs, vehicle telemetry, and collision data, if available. When you disengage full self driving supervised, a nag screen asking you why you turned off Full Self Driving, blocks controls on your screen, and cannot be turned off without the driver being forced to respond. This is dangerous while parking and in other scenarios. Especially since the only way to get rid of it is by being a distracted driver, as you cannot use all controls without first answering the question as to why you decided to take over for the automated driving. This happens multiple times per drive, per day. I have included a picture of the bag screen from another driver as I did not feel comfortable taking a picture while driving.

Also present: drive-unit graceful power-off alert (DI_a063), BMS error, and charge-port communication loss (CP_a060). Tesla has issued campaign bulletin SB-24-16-005 (September 2024) acknowledging that a defective component inside the High Voltage Controller on 2023-2024 Model 3/Y "may prevent the vehicle from entering into drive mode, or may cause a graceful poweroff." Tesla classified this as non-safety-related. However, a sudden total loss of vehicle power — which other owners report occurring at highway speeds — creates crash risk, and inoperable doors create an entrapment and access hazard, especially for families with small children. Consumers should be able to set the maximum speed desired or lower it if it goes to high manually, but you can't if you are using self driving options. You can go to chill which is the next level down but that is to slow. Consumers should be able to manual put the speed where they want to drive and feel safe. I was between two cars in the right lane driving down the highway. I believe my vehicle was keeping up with the flow of traffic but no way to slow it down unless i went out of standard self drive. Chill is the one below standard and that is to slow.

It has been towed to Tesla 5 times in the last 6 months. The car will all of a sudden do ALL of the following. Hood pops open Tailgate starts to go up and down The car lights start to flash - all of them The heater goes on 100 percent The seat and steering wheel warmers are activated The horn blows constantly The windows go up and down The stereo goes on full blast I cannot stop any of these things from happening. Tesla has had the car 5 times and said it is all repaired but it comes back every time. I cant trust driving the car anymore

I subscribe to tesla FSD and there's a pop up window every time I disengaged from FSD. There's no way to systematically stop it from popping up. It is a serious distraction from driving, as it blocks part of the map and causes me thinking there's something wrong with the car. I want a way to stop it from popping up.

The Full Self-Driving (FSD) system on my 2024 Tesla Model Y repeatedly causes the vehicle to weave or oscillate from side to side within its lane, particularly at highway speeds. The vehicle is available for inspection upon request. The most serious incidents have occurred at highway speeds while traveling in the left lane next to a concrete median. The vehicle has weaved so severely that it has nearly caused me to hit the concrete median. I attempted to steady the steering wheel with my hands, but this was not sufficient to stop the oscillation. I had to immediately disengage FSD to stop the behavior and regain stable control. This has happened more than once. The problem is independent of rain, wet pavement, poor weather, or unusual road conditions. I have experienced it in dry, clear weather and normal road conditions. There are no warning lamps or messages before the weaving begins. Tesla inspected the vehicle for this problem on July 22, 2026. Tesla Service found no physical defect and told me the behavior was a known software/firmware problem that could not be repaired at the service-center level. Tesla personnel indicated that similar behavior was known to be occurring in Europe. I was told that a future software update would correct the problem. Since then, Tesla has released multiple software/FSD updates and my vehicle has received subsequent updates. The weaving may have improved slightly on city streets and at lower speeds, but I have not observed meaningful improvement at highway speeds, where the greatest safety risk occurs. The weaving also creates a risk to surrounding traffic because the vehicle may appear to other motorists to be driven by an impaired or otherwise unsafe driver, potentially causing them to react to its unpredictable movement. Tesla has inspected and acknowledged the problem, but the high-speed safety issue remains unresolved and they do not expect any additional remedy from the dealer for my vehicle.

The contact attempted to contact the manufacturer by phone, but could not get through the automated answering system. The failure mileage was unknown.

My 2024 Tesla Model Y (VIN [XXX]) has lost all forward camera-based safety and driver assistance functions. The vehicle displays alerts that Automatic Emergency Braking is unavailable, Park Assist is unavailable, adaptive headlight features are unavailable, and that self-driving is degrading and the vehicle may stop. Autopilot and Full Self-Driving will not engage. The side repeater cameras and the rearview camera still display images normally on the touchscreen, so the failure is not a loss of video display. The loss of Automatic Emergency Braking and forward collision warning means the vehicle has no automated protection against a frontal collision, and the loss of adaptive headlights and auto high beam means the high beams no longer dim for oncoming traffic. I performed a touchscreen reboot and a full power-off reset, and the condition returned. The vehicle is equipped with HW4 hardware and falls within the model years covered by NHTSA campaign 25V002000 (Tesla SB-25-00-001) concerning a computer circuit board short, though my VIN was not included in that recall population. I am reporting this because a vehicle sold with these active safety systems is now operating without them, and I believe other owners of vehicles in this build range may be experiencing the same failure. Component that failed & available for inspection? The power window on the passenger-side rear door failed to auto-reverse when it hit an obstruction while closing. It closed with enough force to pinch and injure my child's finger and did not reverse. The 2024 Tesla Model Y is available for inspection on request. How was safety put at risk? The window was closing automatically (auto-lock), with no one touching the switch, when it pinched and injured my child's finger. FMVSS 118 requires power windows to detect an obstruction and reverse during hands-free closing. It did not reverse at all. This puts children and passengers at continued risk of finger and hand injury. Reproduced/confirmed by a dealer or service center? Yes I reproduced it myself. With a child-sized finger-width carrot placed in the window path during an automatic close, the window failed to reverse and crushed the carrot instead of retracting. I have video of this. Not yet confirmed by a service center; I am scheduling a Tesla Service inspection. Video can be viewed in the attachments that's in GIF format. Inspected by manufacturer, police, insurance or others? Not yet. I am reporting this to Tesla Service and filing this complaint at the same time. Warning lamps/messages/symptoms before failure, and when? None. No warning lamps, alerts, or messages appeared before or during the incident, and there were no prior symptoms that the automatic window reversal system was malfunctioning. Our best guess is that its always been malfunctional.

I am submitting this complaint regarding a safety concern involving the panoramic glass roof of my 2024 Tesla Model Y. My toddler lightly bumped their head against the inside of the roof glass, after which the glass developed a significant starburst crack. The contact was very minor, and the resulting damage raised serious concerns about the safety and durability of the roof glass, particularly because I regularly transport my children in this vehicle. On XXX, I brought the vehicle to a Tesla Service Center in Orland Park, Illinois. Tesla documented my report as a child/passenger safety concern. The technician verified an impact zone, documented that the top/exterior portion of the roof glass was cracked, that the interior section did not crack, and that a portion of the roof glass was pushed inward at the impact zone. Tesla recommended replacement of the roof glass. I requested written confirmation that the vehicle was safe to continue driving with the damaged roof. After escalation, Tesla’s Regional Manager responded that whether it was “safe” was a decision I would need to make at my own discretion and suggested replacement if I did not feel safe. He also stated that Tesla’s glass is deemed safe for its intended use based on testing and government regulations. My concern is not simply repair cost or coverage. When Autopilot is OFF, Emergency Lane Departure Avoidance (ELDA) violently yanks the steering wheel, steering TOWARD hazards like oncoming traffic on the left or a mountain/rock wall past the curb on the right. This creates a severe collision risk, overriding safe manual input.DOCUMENTED PROOF: Provided Tesla Service (Palo Alto) over 12 timestamps and several dashcam footage. Technicians physically verified NO internal/external camera obstructions across TWO separate visits. Moving a transponder failed to resolve it.TESLA REFUSAL: Service Center has canceled TWO other service requests without fixing the defect, claiming it the 'system is working as intended.' Crucially, the Manager Jay explicitly admitted this dangerous steering override is a 'known issue for vehicles without FSD' operating on an older, separate software stack prone to these errors. To resolve this critical safety hazard, he explicitly suggested I purchase Tesla's premium Full Self-Driving (FSD) upgrade, claiming the FSD stack fixes it. Tesla is fully aware their base active safety software stack is defective and steers into hazards, yet demands a paid consumer upgrade to resolve it rather than issuing a safety patch or recall.

On XXX at approximately 7:23 a.m., a 2024 Tesla Model Y was traveling westbound on [XXX] in [XXX] in the middle lane at approximately 71 mph with Full Self-Driving (FSD) engaged. While traveling in traffic, the vehicle suddenly initiated a lane change toward the right lane without providing a warning or sufficient opportunity for the driver to respond. While the Tesla was executing the lane change, a vehicle traveling behind it collided with the left side of the Tesla. Following the impact, the driver manually took control and brought the Tesla to a complete stop on the right side of the highway. The system suspected of malfunctioning is Tesla’s FSD driver-assistance system, particularly its automated lane-selection and lane-change functions. The exact cause has not been determined. The vehicle and its electronic data were preserved. Currently, non-inspection was done. The unexpected maneuver placed the Tesla and surrounding motorists at risk because it occurred without warning at highway speed in active traffic and resulted in a collision. The driver had to intervene manually after the impact to control and stop the vehicle safely. At the time of this report, the suspected malfunction has not been reproduced or independently confirmed by a Tesla service center or independent repair facility. No technical determination of the cause has been received. A police officer arrived immediatly after the accident. An inspection was performed by Insurance company over a video. Before the unexpected lane change, there were no warning lamps, messages, audible alerts, or other symptoms indicating that he vehicle was about to initiate the maneuver or malfunction. The Office of Defects Investigation (ODI) is opening this Engineering Analysis to evaluate Tesla’s Full Self Driving Beta and Full Self Driving (Supervised) (collectively, FSD) degradation detection system. The focus of this investigation will be to assess the system’s ability, when encountering reduced roadway visibility conditions, to detect degradation and alert the driver with sufficient time to respond. ODI will evaluate the performance of FSD in degraded roadway conditions and the updates or modifications by Tesla to the degradation detection system, including the timing, purpose, and capabilities of the updates, and Tesla’s assessment of their safety impact. Tesla’s FSD is an advanced driver assistance system (ADAS) that relies exclusively on vision-based cameras and the related FSD software to detect and respond to the roadway ahead, projecting a path forward based on traffic control devices, vehicles, pedestrians, and the roadway itself. When Tesla began transitioning away from using both cameras and radars to an exclusively camera-based approach, known as Tesla Vision, in mid-2021, it developed and implemented a degradation detection system that it deployed by a software update to existing and new Tesla vehicles. On June 28, 2024, the day after Tesla submitted the SGO report of the November 28, 2023 fatal crash listed in this document, Tesla began developing an update to the degradation detection system. At this time, ODI does not have information on when the update was deployed and which vehicles have the updated system. ODI discussed individual incidents and its initial findings during the PE phase of its investigation with Tesla. As part of those discussions, Tesla’s post-incident analysis indicated that the update to the degradation detection system, had it been installed on the vehicles at the time, may have affected 3 of the 9 incidents identified by ODI. Tesla also described internal data and labeling limitations that prevented a uniform identification and analysis of crash events with the subject system engaged. ODI believes this limitation could have led to under-reporting of subject crashes over portions of the defined time-period. Available incident data raise concerns that Tesla’s degradation detection system, both as originally deployed and later updated, fails to detect and/or warn the driver appropriately under degraded visibility conditions such as glare and airborne obscurants. In the crashes that ODI has reviewed, the system did not detect common roadway conditions that impaired camera visibility and/or provide alerts when camera performance had deteriorated until immediately before the crash occurred. Review of Tesla’s responses revealed additional crashes that occurred in similar environments and where the system either did not detect a degraded state, and/or it did not present the driver with an alert with adequate time for the driver to react. In each of these crashes, FSD also lost track of or never detected a lead vehicle in its path. In upgrading PE24031 to an Engineering Analysis (EA), ODI will gather further information on the updated degradation detection system, including the status of updating vehicles and scope of compatible vehicles, the system’s visibility degradation detection capability, and alerts or warnings to the driver. Lastly, ODI will conduct analysis on six recent potentially related incidents. The Office of Defects Investigation (“ODI”) is opening this Preliminary Evaluation (PE) to assess the scope, frequency, and potential safety consequences of FSD executing driving maneuvers that constitute traffic safety violations. This investigation concerns versions of FSD that Tesla has labeled as "FSD (Supervised)" and "FSD (Beta)." Tesla characterizes FSD as an SAE Level 2 partial automation system requiring a fully attentive driver who is engaged in the driving task at all times. Level 2 partial automation systems are designed to support and assist the driver in performing certain aspects of the driving task, requiring a driver to supervise and intervene as necessary. The driver remains fully responsible at all times for driving the vehicle, including complying with applicable traffic laws. ODI’s investigation will therefore focus, in particular, on whether certain driving inputs within the control authority of FSD forestall the driver’s supervision when they are unexpectedly performed. ODI has identified a number of incidents in which the inputs to the dynamic driving task commanded by FSD induced vehicle behavior that violated traffic safety laws. Although reports of this nature span a variety of behaviors, the reports appear to most commonly involve two types of scenarios. The first type of scenario involves a vehicle operating with FSD proceeding into an intersection in violation of a red traffic signal. The second type of scenario involves FSD commanding a lane change into an opposing lane of traffic. With respect to the first type of scenario, ODI has identified 18 complaints and 1 media report alleging that a Tesla vehicle, operating at an intersection with FSD engaged, failed to remain stopped for the duration of a red traffic signal, failed to stop fully, or failed to accurately detect and display the correct traffic signal state in the vehicle interface. Some complainants also alleged that FSD did not provide warnings of the system's intended behavior as the vehicle was approaching a red traffic signal. ODI has identified six Standing General Order ("SGO") reports in which a Tesla vehicle, operating with FSD engaged, approached an intersection with a red traffic signal, continued to travel into the intersection against the red light and was subsequently involved in a crash with other motor vehicles in the intersection. Of these incidents, four crashes resulted in one or more reported injuries. At least some of the incidents appeared to involve FSD proceeding into the intersection after coming to a complete stop. ODI's pre-investigative work, including coordination with the Maryland Transportation Authority and State Police, indicated that the problem may be repeatable, given that multiple subject incidents occurred at the same intersection in Joppa, Maryland. NHTSA understands that Tesla has since taken action to address the issue at this intersection. With respect to the second type of scenario, ODI has identified 2 SGO reports, 18 complaints, and 2 media reports alleging that a Tesla vehicle, operating with FSD engaged, entered opposing lanes of travel during or following a turn, crossed double-yellow lane markings while proceeding straight, or attempted to turn onto a road in the wrong direction despite the presence of wrong-way road signs. Likewise, ODI has identified 4 SGO reports, 6 complaints, and 1 media report alleging that a Tesla vehicle, operating with FSD engaged, proceeded straight through an intersection in a turn-only lane or executed a turn at an intersection in a through lane despite the presence of lane markings or signals. Complaints also alleged that FSD did not provide warnings of the system's intended behavior. Some complaints alleged that more than one of these failures occurred and, as such, the numbers are not cumulative. Some of the reported incidents appeared to involve FSD executing a lane change into an opposing lane of travel with little notice to a driver or opportunity to intervene. ODI’s review will assess whether there was prior warning or adequate time for the driver to respond to the unexpected behavior or to safely supervise the automated driving task. This review will assess any warnings to the driver about the system's impending behavior; the time given to drivers to respond; the capability of FSD to detect, display to the driver, and respond appropriately to traffic signals; and the capability of FSD to detect and respond to lane markings and wrong-way signage. NHTSA's review will also consider any updates or modifications to the system(s) that may affect the performance of FSD with respect to obeying traffic safety laws and signals. This assessment will focus, in particular, on the types of traffic safety violations described above, as most reports identified thus far have centered around those behaviors. While the behaviors under investigation appear to occur most frequently at intersections, NHTSA’s investigation will encompass any other types of situations in which this behavior may arise, such as when traveling adjacent to a lane of opposing traffic or when approaching railroad crossings. If other evidence received during this investigation involve other types of traffic safety violations, those may be considered as part of this assessment as well. (“Tesla”) in response to Standing General Order 2021-01 (the “SGO”), in which the reported crashes occurred several months or more before the dates of the reports. The majority of these reports involved crashes in which the Standing General Order in place at the time required a report to be submitted within one or five days of Tesla receiving notice of the crash. When the reports were submitted, Tesla submitted them in one of two ways. Many of the reports were submitted as part of a single batch, while others were submitted on a rolling basis. Preliminary engagement between ODI and Tesla on the issue indicates that the timing of the reports was due to an issue with Tesla’s data collection, which, according to Tesla, has now been fixed. NHTSA is opening this Audit Query, a standard process for reviewing compliance with legal requirements, to evaluate the cause of the potential delays in reporting, the scope of any such delays, and the mitigations that Tesla has developed to address them. As part of this review, NHTSA will assess whether any reports of prior incidents remain outstanding and whether the reports that were submitted include all of the required and available data. On January 6, 2025, the Office of Defects Investigations (ODI) opened Preliminary Evaluation 24003 (PE24033) to investigate Actually Smart Summon (Summon) sessions resulting in crashes during active sessions. According to Tesla, Summon is a short-distance SAE Level 2 system, controlled by the user from a cell phone within a certain distance and intended for use in parking lots and on private property. ODI analyzed complaint data provided by Tesla as well as complaints submitted to ODI from consumers to identify Summon incidents resulting in crashes. ODI's analysis indicates that almost all Summon reported crashes involved minor property damage claims with no reported incidents involving a vulnerable road user, injury, fatality, or major property damage as indicated by an air bag deployment or vehicle tow away. Out of millions of Summon sessions, a fraction of 1% resulted in an incident. Almost all those incidents took place where, typically early in a Summon session, the system or person using the app failed to fully detect or respond appropriately to vehicle surroundings resulting in minor impacts. Incidents took place when app users did not have a complete 360-degree view of the surroundings in the app to assess situational awareness. This limited the app user’s ability to determine whether an impact was imminent during initial vehicle maneuvers such as reversing in close proximity to an obstacle or a curb. ODI found that the impacts most often occurred with parking gates, adjacently parked vehicles, and short parking bollards. During this investigation, ODI identified two Summon crashes related to camera blockages. In both crashes, Summon attempted to navigate a snowy parking lot with snow partially or fully obstructing the forward-facing cameras. Summon did not detect the camera blockage and the vehicles collided with unoccupied parked vehicles while navigating the parking lot. App users in both instances did not command a vehicle stop or pause despite the obstructed camera visible in the camera stream in the app. On January 15, 2025, Tesla released Over-the-Air (OTA) Software (SW) Update Action numbers 578998 and 579185 for vehicles in service to implement a camera blockage detection condition. Both OTAs improve camera blockage detection mechanisms. Additionally, on January 20, 2025, and January 30, 2025, Tesla identified additional system requirements associated with camera visibility checks and released OTA SW-578752 and SW-580322, respectively. These firmware updates reduce false negative camera blockage detections due to snow or condensation. In its investigation, ODI identified one Summon incident where the vehicle did not yield for a gate arm blocking a garage exit lane and the app user did not command a vehicle stop or pause, resulting in an impact. On February 6, 2025, Tesla deployed OTA SW-578839 to improve vehicle reaction to dynamic gates. This OTA update upgraded vehicle perception systems through a high-fidelity occupancy determination network, which uses data from vehicle sensory systems to improve reconstruction of field objects with high accuracy. On November 20, 2025, Tesla further improved vehicle performance by adding object detections from a separate neural network through OTA SW-580514. Owners of the affected vehicles received all six OTA SW updates. Tesla also released these SW updates to production vehicles. See online public file for detailed descriptions of all six OTA SW updates. Due to low incident occurrence and low incident severity, this preliminary evaluation is closed. The closing of this investigation does not constitute a finding that a safety-related defect does not exist. During this phase of the investigation, ODI reviewed the materials provided by Tesla detailing any actions taken, or changes, modifications, and updates made that may relate to the alleged defect. ODI reviewed information related to Tesla’s transition to a vision-only perception system, and its deployment of the strategy in vehicles. ODI’s findings include information on limitations of the vision-only perception system and updates made in response to known subject crashes. When Tesla began transitioning away from using both cameras and radars to an exclusively camera-based approach, known as Tesla Vision, in mid-2021, it developed and implemented a degradation detection system that it deployed by a software update to existing and new Tesla vehicles. The Office of Defects Investigation (ODI) is opening a Recall Query to assess the remedy adequacy of Recall 23V838. On December 12, 2023, Tesla filed a Defect Information Report (Recall 23V838) applicable to all Tesla models produced and equipped with any version of its Autopilot system, which Tesla described as an SAE Level 2 (L2) Advanced Driver Assistance System (ADAS). Autopilot is the simultaneous engagement of Tesla’s Traffic-Aware Cruise Control (TACC) and Autosteer. In describing the safety defect, Tesla’s Defect Information Report (DIR) explained that “the prominence and scope of the system’s controls may be insufficient to prevent driver misuse,” and Tesla committed to the deployment of a multipart remedy aimed at improving system and engagement controls and reducing mode confusion. EA22002 (upgraded from PE21020) was opened to investigate whether Tesla’s Autopilot contained a defect that created an unreasonable risk to motor vehicle safety and involved extensive crash analysis, human factors analysis, vehicle evaluations, and assessment of vehicle control authority and driver engagement technologies. The work conducted in these investigations aligns with Tesla’s conclusion in its 23V838 recall filing. During EA22002, ODI identified at least 13 crashes involving one or more fatalities and many more involving serious injuries in which foreseeable driver misuse of the system played an apparent role. Tesla filed Recall 23V838 to address concerns regarding the Autopilot system investigated in EA22002. Following deployment of the remedy in Recall 23V838, ODI identified concerns due to post-remedy crash events and results from preliminary NHTSA tests of remedied vehicles. On February 16, 2022, the Office of Defects Investigation (ODI) opened a Preliminary Evaluation (PE22002) to investigate reports of unexpected deceleration while driving with the adaptive cruise control system engaged in Model Year (MY) 2021 – 2022 Model 3 and Model Y vehicles manufactured by Tesla. The subject systems include Autopilot (all versions), Full Self-Driving (FSD) and Traffic Aware Cruise Control (TACC). These complaints have been colloquially referred to as “phantom braking”. ODI opened PE22002 to determine the scope and severity of the potential problem and to assess any resulting safety issues in the subject vehicles. The alleged defect is an unexpected and unrequested vehicle deceleration triggered by the subject system during subject system engagement. The alleged defect does not occur when the subject system is not in use and is separate and distinct from Automated Emergency Braking (AEB). During vehicle operation, AEB is actively monitoring in the subject vehicles regardless of subject system and its intervention is accompanied by audible and visual collision warnings. A Vehicle Owners Questionnaire (VOQ) trend originating in November 2021 prompted ODI to open PE22002. VOQ narratives reported unexpected brake activation while using TACC, Autopilot or FSD. The trend grew from 99 by the end of 2021 to 314 by February 16, 2022, when PE22002 was opened. ODI sent Information Request (IR) Letters to Tesla on May 4, 2022, and July 11, 2024, to request salient data to quantify vehicle production, field incidents, and the physical parameters of the phantom braking reports. ODI also requested information pertaining to Tesla’s internal assessments, problem resolutions, and their assessment of the alleged defect. Typically, the complaints to ODI and Tesla allege a 10-20 mph speed reduction at highway speeds over a 1-3 second time period.No collisions were identified. Drivers reported seeing no vehicles ahead in the travel lane that would have triggered the deceleration. Many complaints reported the conditions taking place on higher speed roadways in sunny conditions with shadows on the roadway. Complainants typically applied the accelerator to override the unexpected deceleration, and subject vehicles did not come to a complete stop or steer out of their travel lane. ODI analyzed data provided by Tesla in addition to consumer complaints submitted to ODI. Tesla’s complaint and field data exhibited some behavior that aligned with the transition from a radar-vision fusion system to vision-only in mid-2021. VOQ traffic coincided with public events such as Recall 21V846, the opening of PE22002, and several related media publications. In February and March of 2022, Tesla released firmware updates 2022.4.5.1 and 2022.4.5.17 respectively to target aspects of the subject system programming that affect unexpected deceleration. Incident traffic has dissipated substantially in the past years, with 45 incidents reported in 2024, 19 in 2025, and 3 since the beginning of 2026. The conditions reported, while concerning to the drivers, did not alter the vehicle’s lateral positioning in their lanes and did not cause significant loss in distance between the subject and following vehicle to lead to a collision. Complaint traffic to both NHTSA and Tesla reported the same conditions- vehicles traveling with the subject system engaged at higher speeds decelerating suddenly with no commensurate vehicle or obstacle ahead in the same lane. In view of these points, and a low demonstrated hazard to drivers, this Preliminary Evaluation (PE) is closed. The closing of this investigation does not constitute a finding by NHTSA that a safety-related defect does not exist. The Agency reserves the right to take additional action if warranted by future circumstances.
