National Highway Traffic Safety Administration Office of Defects Investigation / Vehicle Safety Hotline 1200 New Jersey Avenue SE West Building Washington, DC 20590 RE: VEHICLE SAFETY COMPLAINT 2019 Ford Fusion Hybrid Ford Recall 23S33 / NHTSA Recall 23V440/June 16, 2023 To Whom It May Concern: I am submitting this correspondence to formally document a potentially serious safety concern involving my 2019 Ford Fusion Hybrid, which is subject to Ford Recall 23S33 / NHTSA Recall 23V440. I have made multiple attempts to have the outstanding recall completed through AutoNation Ford Wolfchase, located at 7925 Stage Road, Bartlett, Tennessee 38133. During previous attempts to schedule the recall repair, I was advised that parts would need to be ordered and that the dealership might need to retain my vehicle for more than two weeks. I was told I would be contacted when the required parts became available. However, I did not receive the promised notification that the parts had arrived or that the repair could be completed. During this period, my vehicle displayed an “Extreme Overheated” warning during normal operation. I reported this condition to the dealership. On [XXX], I brought the vehicle to AutoNation Ford Wolfchase after experiencing an additional serious condition involving the 12-volt battery and an extremely strong sulfur/rotten-egg odor. The odor was severe enough to be readily noticed by dealership personnel and mechanics when the vehicle arrived. Their reaction to the odor caused me additional concern about whether the vehicle had been safe to operate. I am concerned that I was operating a vehicle with an unresolved safety recall while simultaneously experiencing overheating warnings and, ultimately, an abnormal battery/charging condition accompanied by a severe sulfur odor. I understand that a technical inspection is necessary to establish whether these conditions were caused by or related to Recall 23S33/23V440 I have mailed out a certified letter INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATI

This is my 2nd complaint on the non action to repair this recall. Ford's latest attempt to NOT repair the electrical defect is to buy my car. Their offer does meet the cost of buying a replacement car. Is Ford so inept that they cannot repair their own products? The offer to buy the car sends a red flag up. Is Ford's "solution" to buy my car an attempt to acquire cars to resell at a profit? If Ford cannot repair a defect that was diagnosed a long time ago, should they be allowed to continue to manufacture and sell cars in the United States? Has Ford been sanctioned in any way for this defect?

The lane keep assist does not work basically , it can't detect the lines , due to the recall I can't charge my car which I paid much more than regular ford fusion. To be able to use the Electric miles and save on gas , also the 3G modem stopped working and ford has no fix for that , took it to different dealers and they say even if I replace the old modem with a new 4G, (paying out of my own pocket !!) most likely the app and remote connection will not work .

NHTSA’s Office of Defects Investigation opened these reviews into vehicles including this one.
NHTSA received a petition on or about July 18, 2022, requesting that Federal Motor Vehicle Safety Standard (FMVSS) 141 be applied to all electric and hybrid vehicles operating in the United States. The petition can be reviewed at NHTSA.gov under ODI Number 11486072. FMVSS 141 establishes performance requirements for pedestrian alert sounds for motor vehicles. The standard applies to hybrid and electric vehicles that have a gross vehicle weight rating of 4,536 KG or less or are defined as low-speed vehicles. The standard became fully applicable to all such vehicles manufactured on or after March 1, 2021.On January 27, 2023, NHTSA opened Defect Petition (DP) 22-005 to evaluate the subject matter described in the petition. On June 24, 2023 and as supplemented on June 25, 2023, the petitioner notified NHTSA he was withdrawing his petition. The petitioner indicated that, based on his review of data, there is no justification for asserting potential benefits that could be derived from actions sought by my petition. Based on the petitioner's withdrawal, DP22-005 is closed. Closure of this DP does not represent a determination by NHTSA regarding the subject matter of the petition.
